BOOKING TERMS AND CONDITIONS
PLEASE READ THESE TERMS & CONDITIONS CAREFULLY

By using this website and the Tynrhyd Retreat online booking service you are agreeing to be bound by the Terms and Conditions detailed below which form the basis of your contract with Tynrhyd Retreat. In the Terms & Conditions set out below, “you” and “your” refers to all persons named on the booking, which includes any individual(s) subsequently added or substituted at a later date. “We”, “us” and “our” all refer to Tynrhyd Retreat.
Unless otherwise agreed at the time of your booking and confirmed in writing by us on your booking confirmation, Tynrhyd Retreat comprising Tynrhyd Cambrian, Pumlumon, Barcud and also Tynrhyd Farm House are let on the following terms and conditions:

1. The Contract

1.1 The contract entered into is between Gareth & Sian Price (the Owners of Tynrhyd Retreat) and the person completing and signing the Booking Form (the Hirer).

1.2 The contract is not effective until the required payment has been received and confirmation sent from the Owner to the Hirer.

2. Booking

2.1 Bookings cannot be accepted by:

  1. Persons under the age of 21 years
  2. Parties where the majority of members are under 21 years (except families or supervised groups)

2.2 Provisional bookings must be confirmed within 24 hours of booking by paying a non-refundable deposit of no less than 30% of the total booking value.  We may extend this period at our discretion.

2.3 Bookings made via our online system remain provisional until confirmed by us. We aim to respond to all booking requests within 24 hours. 

2.4 The balance of your booking must be received at least 8 weeks prior to your holiday start date.   

2.5 A returnable damage deposit of £450 is payable with your final balance payment and at the discretion of the owners, may be applied on a per house basis.

We reserve the right to swipe your payment card on arrival. This will not result in any money taken from your account at this time. However, in the event of any damage or excessive cleaning works being required as a result of guests’ behaviour / activities not covered by the damage deposit bond, this will authorise us to take the monies owed without the need for additional consent.

2.6 In the case of bookings made within less than 8 weeks of your holiday start date, the full booking cost is due at the time of booking.

2.7 We accept payment by either; bank transfer; cash; or by cheque made payable to “Tynrhyd Retreat”

Where we are able to offer payment by card, there will be a 2.5% charge for all credit card transactions.

3. Making a Booking and Payment: 

A completed booking form must show the names and ages of all persons on whose behalf you are making the booking must be accompanied by a non-refundable security deposit amounting to 30% of the total hire fee.

The person who signs the booking form will be treated as doing so on behalf of and with the consent of all the

persons for whom the booking is made. That person will be responsible to us for full payment of the price (including any insurance premiums, cancellation or alteration charges) of the holiday booked. No contract shall exist between you and Tynrhyd Retreat until a confirmation of booking showing the arrangements booked has been issued. The full balance owing to Tynrhyd Retreat must be paid at least 8 weeks before arrival. If Tynrhyd Retreat does not receive the balance on time we reserve the right to cancel the booking, retain deposit and levy charges. If the booking is made within 8 weeks of holiday start date, you must pay for the holiday in full.  Payment for overseas bookings can be made by cheque drawn at a London bank payable in Sterling to G& SH Price or by any bank transfer to the Owners’ account (remitter to pay all charges).

4. Booking Number

The Client must comply with the maximum number of persons allowed to occupy the accommodation. If numbers are in excess of the maximum occupancy, or those agreed on booking, we reserve the right to insist on the Client vacating the property or an extra fee be charged.

5. Price

Prices are accurate at the date of publication and should be used as guidance.  We reserve the right to increase or decrease our brochure, website or other advertisement prices, and our price quotation at any time according to group numbers and holiday type, prior to the owners confirming and accepting a booking. Once you have booked, the price of your holiday is guaranteed, except that Tynrhyd Retreat may pass on to you any increases due to Government levies, tax or fuel surcharges. On any surcharges imposed, Tynrhyd Retreat will absorb an amount up to 2% of the holiday cost.

6. Cancellations:

6.1. Cancellation Notification more than 8 weeks prior to holiday start date:

If the cancellation is notified to us more than 8 weeks prior to the original start date, only the non-refundable deposit will be retained. Any other monies paid will be returned to you.

6.2. Cancellation Notification less than 8 weeks prior to the holiday start date:

If notice of the cancellation is received less than 4 weeks prior to the original start date, AND Tynrhyd Retreat are unable to re-let the accommodation for the same period, the rental will be payable by you in full. Where the accommodation is re-let, the non-refundable deposit of 30% will be retained, with any other monies paid being returned to you, less any loss of income incurred by us.

6.3. Cancellation or Alteration by the Client

Cancellation will only take effect when written notification is received from the person signing the booking form. If cancellation is received in writing prior to 8 weeks before holiday start date, deposit and insurance will be forfeited.

6.4. Cancellation or Alteration by Tynrhyd Retreat

In the unlikely event it becomes necessary to change your booking, in total or in part Tynrhyd Retreat will inform you as soon as is reasonably possible of any necessary changes. You shall have the choice of: accepting the changed arrangements; (or purchasing another booking (and paying or receiving a refund in respect of any differences) or cancelling your booking and receiving a full refund of all payments made.  Where cancellation or alteration is by reason of unusual and unforeseeable circumstances beyond the control of Tynrhyd Retreat, the consequences of which could not have be avoided even if all due care had been exercised, we will return all money paid to us or offer you an alternative holiday. We reserve the right to make minor alterations to holiday arrangements without incurring any liability to the client.

6.5. We would strongly advise you to consider taking out a Holiday Cancellation Insurance Policy.

7. Check-in and Check-out: 

7.1 Your cottage should be available to you from 4pm on the day of arrival and must be vacated no later than 10am on the day of departure. Early arrival check-in may be available, however, fees will apply, please email for further details. 

7.1.1 We reserve the right to apply a late check-out fee, where i.e late check-out is available and agreed with management, at a rate from £25 per room.  This rate is at the entire discretion of management and will vary according to booking type, requested late check-out time and actual check-out time.

7.2 Guests should check-in by reporting to the office, on-site.

7.3. Valid ID Required

We work hard to create a safe and welcoming atmosphere for all our guests. To assist with this, you will be asked to provide valid ID on arrival at Tynrhyd Retreat. We reserve the right to ask for ID from any guest on check in. We reserve the right to refuse accommodation at our discretion.

7.4 All guests will need to provide proof of identify that matches the name and/or address on the booking. Any of the following is accepted by Tynrhyd Retreat as an appropriate form of ID:-

Current Passport - This is Mandatory for Non UK residents, unless they have a Recognised or National Identity Card if the guest is from within the European Union.

Services ID - Fire, Police or Forces

Valid, photographic, driver's license, no older than 10 years old

Student Identity Card, from a UK university with a current admissions date

A Bank Card when accompanied by another card that has the individuals name embossed on it, or accompanied with a letter with a matching name and address to the booking.

7.5. Parking: There is ample free parking at Tynrhyd Retreat for cars, minibuses and coaches.

7.6. Pets: Well behaved pets are accepted at the discretion of the owners but, with the exception of guide dogs. Please inform the owners of Tynrhyd Retreat prior to arrival if you intend to bring a pet.  

DOGS

7.6.1 We welcome pets but charges are applicable; £25 for up to 3 dogs and £25 per pet over 3 dogs. In order to ensure that the Owners continue to welcome dogs the Hirer must undertake the following:

  1. There must be no more than five dogs at the property at any time.
  2. All dogs must be kept under strict control at all time whilst on the property.
  3. Any fouling of lawns, paths etc must be cleared up without delay.
  4. The Hirer must bring the dogs bedding.
  5. Dogs must not be left in the property unattended.
  6. Dogs are not allowed on beds, chairs or settees.
  7. No dogs under 12 months old to be brought unless arrangements were specifically agreed with the owners prior to booking.

7.6.2 In the interest of visitors' safety and as a result of government legislation the Owners are unable to accept the following types of dog: American Pit Bull Terrier, Japanese Tosa, File Brasieiro and Doga Argentino even where these types of dogs are muzzled as required by law.

7.7. Guests are not permitted to let or sub-let any part or all of the property. 

7.8. Guests are not permitted to invite non-paying guests or service providers on to the site without prior written approval to the owners.

7.9. Taxes: All prices include VAT tax at the prevailing rate at the time a payment is made.

7.10. Tourist attractions: To avoid disappointment you should check the seasonal and/or daily opening times of any tourist attractions/ travelling services prior to arriving at Tynrhyd Retreat or the attraction concerned.

8. Accommodation Inventory & Condition

If there are any problems about the condition of the accommodation and any inventory discrepancy, the Client should contact Tynrhyd Retreat directly. (Please refer to our Guest Handbook)

9. Facilities

All heating, electric, bed linen and towels included.  Initial fuel for wood burners provided, remainder at cost. Travel cots and highchairs available on request. Access ramp and double doors suitable for wheelchairs.

FREE Wi-Fi – the password can be found in the guest handbook which will be provided upon your arrival

Additional accommodation on-site may be made available. Request should be directed to the owners via the website, email or phone. Landscaped garden with gas BBQ’s. 13-acres of private grounds with field for exercising dogs.

Swim spa and hot tub for eight persons (daylight hours use only). Outdoor table tennis. Full size football/rugby pitch with combination posts. 

There are multiple steps within the ground floor of the property. There are sloping banks, a shallow stream and two ponds in front of Tynrhyd Farm House and there are steps in the grounds. The property has a natural water supply from a borehole.

10. Client Responsibility

You accept responsibility to conduct yourself and your party in an orderly fashion while on holiday and to not disrupt the enjoyment of others or prejudice the reputation of Tynrhyd Retreat.  The holiday of any client breaking this clause shall be terminated and Tynrhyd Retreat will have no further responsibility to them. You agree that any loss or damage to accommodation or property caused by a client will be recovered immediately and paid in full.  You are responsible for looking after the property and its equipment during the period of hire and are expected to take good care of it.  

10.1 Your Responsibility and Behaviour

10.1.1 Whether a Group booking, or a booking made by or on behalf of individuals, if the behaviour of yourself or any member of a party is considered likely to cause danger, damage or offence, we reserve the right at our reasonable discretion to cancel or terminate a stay completely. If any member of Tynrhyd Retreat staff considers that the behaviour of any member of your party is unacceptable, they are authorised to end the stay and you will be asked to leave Tynrhyd Retreat premises.  Should this situation arise our responsibility for your booking will cease and we will not be obliged to cover any expense which may be incurred by the party concerned, neither will we consider any claim for compensation or refunds. You are responsible for the cost of any damage caused by yourself or your party during your stay, these charges will be levied by and should be paid to G&S Price, Owners of Tynrhyd Retreat. Should any such behaviour halt or interrupt Tynrhyd Retreat's ability to continue to trade any bed, room or other product, you will be responsible for compensating Tynrhyd Retreat in full for all losses directly or indirectly incurred. Furthermore, such behaviour or damage may lead to civil or criminal proceedings where appropriate. By these terms and conditions you agree that Tynrhyd Retreat may at its discretion take a £450 pre-authorization (on your credit or debit card) as a security bond towards damage caused by you or your group to Tynrhyd Retreat property during your stay (For the avoidance of doubt such bond will only be claimed in the event of damage as referred to above).

10.2 We pride ourselves on creating a friendly, welcoming and above all safe places for people of all ages to enjoy. Any breaches of our admission, behaviour or safety policies will be treated seriously and regarded as a breach of these terms and conditions.

10.3.1 Party Leader responsibilities - As a group leader making a group booking you are also accepting responsibility for the behaviour of all participants. There should be at least one responsible adult on duty at all times, this is in order to ensure all participants behave according to Tynrhyd Retreat policy.

10.3.2 This booking has been entered into on the understanding that the total number in your party shall not exceed the total number of beds available at Tynrhyd Retreat as stated on the property website.

10.3.3 You are considered to be the group leader and must be over 21 years old. You are responsible for the payment of the booking, the safety of the group and the general housekeeping of the property during the stay.

10.3.4 You are responsible for looking after the property and its equipment during the period of hire and are expected to take good care of it.

10.3.5 You are advised to check on arrival and report any shortcomings, damage or missing items immediately to the management team.

10.3.6 You must report and pay for any damage caused to the property or for equipment lost, damaged, broken or stolen during the occupancy.

Unsuitable substitutes are not accepted. All the equipment, utensils etc. must be left in a clean condition at the end of the hire period. A charge of £14.00 per hour will be made by us if any additional cleaning is required. Please ensure that all gas cookers, lights and taps are turned off, doors and windows are secured, rooms are left clean and tidy and waste bins are emptied, before handing the key back to the management team at the on-site office.

Important Note: The use of candles, incense burners, flammable liquids/gases, camping stoves and firearms is strictly prohibited at Tynrhyd Retreat. Use of such items may result in the party being asked to leave immediately, without refund of any portion of the hire fee.

11.1. Breakages, Missing Items, Damage and Behaviour

It is the Clients' responsibility to ensure that the accommodation is left in a clean condition, with replacement of all breakages, if this is not possible, the breakage should be reported to Tynrhyd Retreat and paid for. The client must adhere to all accommodation regulations which are provided in the information document on arrival. A returnable damage deposit is payable 8 weeks in advance with the balance payment, less any costs incurred for cleaning and damages not reported or paid for. Tynrhyd Retreat shall be entitled to recover from the Client costs for damages or losses caused by the Client or a third party. If the Client fails to do so, the Client must indemnify Tynrhyd Retreat against any claims (including legal costs) subsequently made against Tynrhyd Retreat as a result of the Client's actions. Tynrhyd Retreat and its Agents reserve the right to terminate the holiday of any Client whose behaviour or that of any of the Client's party is considered to be unacceptable. Any missing items from the accommodation, or breakages incurred to the accommodation will be charged back to the Client security deposit. It will be the actual cost of material plus Tynrhyd Retreat labour charged at £50 per hour. 

You are legally bound to reimburse us for replacement, repair or extra cleaning costs on demand (although we would not charge for the odd glass or plate). If you lose a key we will replace it upon you paying for the cutting of the new one.

11.2      The Hirer agrees:

  1. That the supervision of children, babies, dogs and any adults requiring care remains the responsibility of the Hirer at all times.
  2. To be responsible for leaving the accommodation in good order and clean condition, otherwise a cleaning charge will be levied.
  3. To pay for any damage or loss however caused, excluding reasonable wear and tear incurred during occupation.
  4. To report any damages as soon as possible to the owners so that they may organise any necessary repair, cleaning or replacement before the start of the next letting week.
  5. Not to cause nuisance or annoyance to occupants of nearby property.
  6. To allow reasonable access to the property by the Owner if it is deemed necessary.

12. Drugs and Smoking Policy

Please note that Tynrhyd Retreat operate a no smoking and no drugs (other than medical) policy. 

12.1. No smoking is allowed inside the premises.

12.2. Drugs, possession or usage, other than medical, are strictly prohibited inside or on the premises.

13. Insurance
It is your responsibility to ensure that any insurance cover you have provides adequate cover for your needs and for the duration of your stay.

14.  Promotional Bookings Terms & Conditions

Promotional offers will be subject to specific terms and conditions and where they may conflict with these terms and conditions the terms and conditions of the promotional offer shall apply throughout the offer period. This shall apply for stays of one night or more at this property and all reservations shall be paid in full prior to arrival. Any additional products or services included in these offers cannot be cancelled. No amendments or refunds can be made and offers are non-transferable. Offers are available at selected locations only and are subject to availability. Advertised rates are inclusive of VAT. This does not affect your rights should Tynrhyd Retreat cancel your booking in which case clause applies. Tynrhyd Retreat reserves the right to withdraw promotional offers at any time, without prior notice.

15. Complaints
It is our aim to settle any complaints amicably and quickly. Should you have any problems whilst on holiday please contact the owners or duty manager as soon as possible so that all reasonable efforts can be made to rectify the situation. If, for any reason, the issue cannot be resolved to your satisfaction and you wish to make a complaint, a written notification must be given to us no later than 28 days after the end of your holiday.

16.  Liability
We cannot accept responsibility for unforeseen circumstances beyond our control. These include (but are not limited to) adverse weather conditions, fire, riot, war, terrorist activity (or threat of such activity), industrial dispute, natural disaster, or injuries and death of an individual(s) through accidental circumstances unconnected with the property.
By making a booking you are accepting responsibility for any damage or loss caused by yourself or a member of your party. Full payment for any such damage or loss must be paid to the hotel owner or manager on demand. If you fail to do so, you will be responsible for meeting any claims subsequently made (together with our own and the other party’s full legal costs) as a result of your actions. Tynrhyd Retreat cannot be held responsible for or pay any compensation where any loss, delay or costs are caused by war, threat of war, riot, civil strike, industrial dispute, political unrest, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions, closure of airports, ports, stations, or roads, or for service disruptions such as WI-FI not within our control, and all similar events. This list is by way of example and not by way of limitation. Tynrhyd Retreat does not accept liability where events are due to no fault of Tynrhyd Retreat nor its suppliers or agents, failure or the fault of you or a member of your party, fault of someone not connected with your party or Tynrhyd Retreat, an event which even with all due care and diligence could not be foreseen or forestall.

17.  Third party websites and viruses
Tynrhyd Retreat cannot be held responsible for the accuracy, content, or availability of information about our holiday complex or our organisation that may be found on third-party websites. Neither are we responsible for the content or privacy policies of any third-party websites that have links to or from the Tynrhyd Retreat website.
Attempts to interfere with the operation of our website, by whatever means, or any attempt to place an unreasonable or disproportionate load on our website or server infrastructure is prohibited.
In the event of our website failing to operate, either in whole or in part, due to infections by computer viruses, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond reasonable control, we reserve the right in our sole and absolute discretion to prohibit usage of our site and to cancel, terminate, modify or suspend the site.

Tynrhyd Retreat nor any party involved in creating, producing or delivering this site shall be liable for any damages arising out of any access to, use of, or inability to use this site.

19. Wedding and special occasions and functions

Specific terms and additional conditions apply for full details of these please enquire within prior to booking. BOOKINGS FALLING UNDER THESE CATEGORIES WILL NOT BE ACCEPTED VIA ONLINE BOOKING AND/OR UNLESS PREVIOUSLY AGREED WITH THE OWNERS IN FULL.

20. Exclusivity

20.1. Bookings will not assume guaranteed exclusivity of the complex. 
Requests for exclusive use of the property should be made in writing for the owners’ consideration. Exclusivity of use will be considered and where the owners can provide this guarantee the owners will confirm this in writing. The owners cannot guarantee exclusivity of use of Tynrhyd Retreat as a complex in all circumstances.

21. LEGAL PROVISIONS

21.1 The construction, validity and performance of this Agreement is governed by the law of Her Majesty’s Courts of Justice of England and Wales and the parties agree to submit to the jurisdiction of the English and Welsh Courts.

21.2 The Hirer agrees that the Contract with the Owners is made at the Owners' premises and that any proceedings between the parties shall be conducted in the County Court nearest to the Owner.

21.3 Clause headings are for convenience only and do not form part of or affect the interpretation of this Agreement.

ONLINE PRIVACY POLICY STATEMENT FOR TYNRHYD RETREAT

We are committed to ensuring the best standards of practice in all our activities. Visitors to our web site can be assured that the protection of privacy and confidentiality are given the highest priority. All personal information is collected, held and used in strict compliance with the Data Protection Act 1998.

Information Collected

We do not collect any personal information from visitors to our website other than information that is knowingly and voluntarily given. Anonymous information is collected, such as the number of visitors to the website in a given period or details of properties and dates selected for online bookings, but it is purely statistical and cannot be used to identify an individual user. Cookies are not used to collect any other information from visitors to the website. Visitors interested in requesting more information can provide contact details via a fill-in form. Visitors cannot be contacted unless such information is given. Visitors are also invited to give additional company information but a decision not to do so does not affect any subsequent negotiations or discussions.

From time to time, we may request for audio-video-photo footage to be taken on site with your prior verbal consent, to be used purely for marketing and promotional purposes in connection with Tynrhyd.  Guests should inform us at the earliest opportunity in writing should you object to this.

Use of Information

The information collected will be used to contact you with further details of our current activities or to send details of future initiatives or events. It may also be used for research purposes. You can inform us at any time if you no longer require such information to be sent.

If you provide your email address to us, you agree that we may send information to you by email in relation to our Services and in relation to any new services, initiatives or events. You will have the opportunity to unsubscribe from any such emails at any time.

We will share your details with our booking system, Super Control for the purpose of them delivering their service to us. For example they provide a verified reviews service and we may ask this service to send you an email invitation to submit a review about your stay. We will NEVER sell your details to any third party. You consent to us providing your details to Super Control in this way. You will have the opportunity to unsubscribe from any such emails at any time.

Data Security

We take appropriate measures to safeguard the information we hold from unauthorised access or improper use. Our database is stored in a secure, password protected location. Only users authorised by us have access to this data.

Data Privacy Statement

We treat any data collected during the course of making bookings or dealing with enquiries in strict confidence. Your data will never be sold. As a way of keeping in touch we send promotional emails from time to time. By accepting these terms and conditions you are indicating your consent to receiving these communications from us unless you let us know otherwise, which you can do at the point of booking by ticking the Marketing Notes box in the extras section. If at any time you would like your details removed from this list all you need to do is click the unsubscribe link on any of the emails or contact us on holidays@tynrhyd.com and we will arrange for you to be removed from the mailing list.

Integrity of Data

We take all reasonable measures to ensure that the information we hold is accurate. In particular we use reliable collection methods and destroy or convert to an anonymous form, any out-of-date data. Individuals may request details of all personal information held by us so as to contest inaccurate or incomplete data, verify the information and have it corrected as appropriate.

Children

Our website is not targeted at children but in any event personal information will not knowingly be collected from children under sixteen years without parental consent.
